Couple Files Lawsuit Against Monash IVF for Alleged Negligence in Embryo Mismanagement

A couple has initiated legal proceedings against Monash IVF due to a serious error in which a woman gave birth after receiving the embryo of another patient instead of her own. They are alleging negligence and breach of contract, claiming that the incident has resulted in significant psychological trauma for them.

Earlier this year, Monash IVF announced that it had settled with other families affected by this mix-up at its Brisbane clinic, where the mistake first came to light in February 2025.

The couple involved in this new lawsuit alleges that they believed the child born from the implanted embryo was genetically theirs until they learned about the mix-up from the birth mother. They claim that Monash IVF informed them of the error only days later.

Filed in the Supreme Court of Victoria last month, the lawsuit asserts that the couple has endured emotional distress, including trauma and grief, stemming from the IVF clinic’s error. The couple contends that their embryos were intended for the mother who gave birth, and they are seeking accountability for the psychological impact of the situation.

In their claim, they outline several allegations against Monash IVF, including inadequate systems for ensuring the correct embryos are transferred and failures in record-keeping that contributed to the mix-up.

In response to inquiries from the media, a spokesperson for Monash IVF stated that the organization does not comment on specific ongoing legal matters. However, following the earlier settlements, the spokesperson expressed deep regret for the incident that occurred in 2025 and highlighted that the clinic has taken substantial measures to enhance its safety protocols and oversight functions.

The spokesperson also assured the public that they have collaborated closely with regulatory bodies to ensure their practices not only meet but strive to exceed required standards and public expectations. “Patients can be confident that we have learned from these events and taken decisive steps to ensure our systems are as rigorous and robust as possible,” the spokesperson added.
