The Calcutta High Court has recently dismissed criminal charges against a man and his mother, asserting that claims of cruelty cannot be upheld when the underlying issue pertains to child custody, as the child’s welfare is of utmost significance.

Justice Apurba Sinha Ray highlighted that the child’s entitlement to grow up in a secure and nurturing environment should take precedence. In this case, the minor expressed a reluctance to reside with his mother, which distinguishes this situation from typical cruelty allegations.

The ruling emphasized that the interests and well-being of the child are not only a priority for parents but also for the judiciary, which is responsible for safeguarding children’s rights. The court found valid reasons for removing the child from the custody of the mother, concluding that the actions of the husband did not constitute actionable mental cruelty. The order stated that the child’s best interests should be prioritized over the mother’s alleged claims of mental distress.

On May 5, the court remarked that children are invaluable assets to the nation and possess a universally acknowledged right to grow up in a safe environment, free from harm and exploitation.

This decision arose from a criminal revision petition filed by the husband and his mother, who sought to annul the FIR and chargesheet lodged against them.

The case originated from a marital dispute involving a couple married in 2005, with their son born in 2012. The wife claimed that following the child’s birth, she endured various forms of mistreatment from her husband and in-laws, which allegedly escalated over time.

The husband contended that since 2014, they had been living separately while still residing in the same house. In November 2021, while the wife was away, he and his mother purportedly left their ancestral home with the minor child.

The wife alleged that her husband took their son without her knowledge and also absconded with some cash and jewelry. This led her to file a formal complaint in December 2021, which resulted in the registration of an FIR under Section 498A of the IPC concerning dowry demands and associated charges of cruelty.

Following an investigation, a chargesheet was filed against the husband and his mother. Their subsequent discharge application was denied by the trial court in June 2023, prompting them to appeal to the high court to terminate the proceedings.

During the dispute, the husband referred to a psychological assessment conducted by a private institution, claiming it indicated that the child was distressed and mistreated by the mother. The wife contested this assessment, arguing it was carried out without her knowledge and lacked credibility.

Simultaneously, custody issues regarding the child emerged. Throughout these proceedings, the child communicated his unwillingness to reside with the mother and expressed fear about returning to her care.

Advocate Smarajit Basu, representing the wife, argued against the reliability of the psychological assessment, emphasizing that it was conducted without her knowledge and by a private entity. He asserted that the timeline of events clearly demonstrates a sustained pattern of mental torture inflicted on the wife.

Basu highlighted that the husband’s actions caused her significant emotional distress and trauma, including secretly subjecting the child to psychological evaluation without the mother’s consent, unlawfully taking the child from her custody, and openly disregarding judicial orders regarding her access to the child.

In contrast, Senior Advocate Jayanta Narayan Chatterjee, representing the husband, argued that the couple had been living separately under the same roof since 2014. He insisted that the petitioners never demanded dowry and presented the private psychologist’s assessment as evidence of the mother’s mistreatment of the child.
