A judge in Utah has determined that Tyler Robinson, the individual charged with the murder of Charlie Kirk, will face trial for aggravated murder, a serious felony that could result in the death penalty if he is found guilty. This ruling was issued on Tuesday after extensive closing arguments in Provo, Utah.
Judge Tony Graf concluded that there is adequate evidence to proceed with the trial against the 23-year-old Robinson, who has entered a plea of not guilty following the judge’s decision. A specific date for the trial has not yet been established.
A pivotal consideration for the aggravated murder charge is whether the shooter acted with awareness of the potential danger to others during the incident. Judge Graf remarked, “The circumstances suggest a reasonable inference that the defendant recognized that other people were nearby Mr. Kirk when he discharged his weapon.”
The defense team for Robinson contended that the shooting should not be classified as a capital crime since the gunman targeted only Kirk and did not endanger others. According to Steve Burton, director of the Utah Defense Attorney Association, Judge Graf could have opted to proceed with a lesser murder charge, which would carry a minimum sentence of 15 years and a potential life sentence.
Kirk was tragically shot while addressing an audience at Utah Valley University nearly a year ago. The legal proceedings began Tuesday morning, with Judge Graf permitting cameras in the courtroom for the hearing, despite pushback from the defense, and making decisions on how the prosecution’s evidence would be presented. The judge also instructed those present in the courtroom to refrain from making comments or showing visible reactions during the session.
Prosecutors allege that Robinson, a former electrical apprentice, fired the single shot that resulted in Kirk’s death at the university campus in Orem on September 10, 2025. They emphasized in court that there is significant evidence, including video footage showing Robinson on campus at the time of the shooting, supporting their claim that he is the shooter.
These court proceedings follow a preliminary hearing held in July, which was attended by Kirk’s widow, Erika Kirk, who was also present on Tuesday. The prosecution previously presented what they described as “overwhelming” evidence, including DNA test results purportedly linking Robinson to the murder weapon. The defense challenged the validity of the DNA testing, arguing that law enforcement did not adequately investigate alternative suspects.
Prosecutors further claimed that Robinson, who was in a relationship with his roommate Lance Twiggs, specifically targeted Kirk due to his political stance against same-sex marriage and transgender rights. This assertion may strengthen the prosecution’s case as they seek the death penalty. Conversely, defense attorneys have stated that there is no evidence indicating Robinson opposed Kirk’s political views. Kirk was a co-founder of Turning Point USA and played a significant role in galvanizing support for Donald Trump among younger voters.
Following the shooting, Erika Kirk, who took on the roles of CEO and board chair of Turning Point USA after her husband’s passing, expressed her forgiveness towards the alleged shooter, although she has not publicly addressed the possibility of a death penalty in this case.
