A judge has ruled that Tyler Robinson will face trial for aggravated murder in connection with the shooting of political activist Charlie Kirk on September 10, 2025, at Utah Valley University. The decision was announced by Judge Tony Graf on Tuesday.
Prosecutors believe they have sufficient evidence to bring the 23-year-old Robinson to trial on the aggravated murder charge, which could result in severe penalties, including the death penalty, life imprisonment without the possibility of parole, or a sentence of 25 years to life with the chance of parole.
During a court recess in Provo, Utah, earlier that day, Judge Graf mentioned he required additional time to review the extensive notes he had taken during the closing arguments of a preliminary hearing held for Robinson.
The prosecution presented a significant amount of evidence over a five-day period in July, establishing a foundation for the aggravated murder charge. They argued that Robinson knowingly endangered others when he allegedly targeted Kirk due to his political ideology, fully aware that children were present in the vicinity.
Judge Graf indicated that his ruling was influenced by the documented presence of several individuals near the area where Kirk was speaking when the shooting occurred. He stated, “These circumstances support a reasonable inference that the defendant was aware that other individuals were positioned near Mr. Kirk when he fired.”
Following the preliminary hearing, Erika Kirk, the widow of Charlie Kirk, submitted a request for the judge to reach a decision by September 1. In a statement sent via email after the ruling, Kirk’s family expressed that this development is a significant step toward achieving justice for Charlie, who was taken from them nearly a year ago. They emphasized the emotional toll of his murder on the family, particularly on his children, who will grow up without their father.
The family expressed gratitude for the support and prayers they have received throughout the past year of their grief. They affirmed their unity in love for Charlie, their commitment to seeking justice, and their hope for a transparent and timely judicial process.
During the proceedings, prosecutors asserted that Robinson shot and killed Charlie Kirk due to a disagreement with him, using a high-powered rifle in a crowd of thousands. They claimed there is an “overwhelming” amount of evidence against him.
The defense, in their closing arguments, focused on contesting the prosecution’s claims of aggravating factors that would justify the death penalty. They contended that the prosecution had not proven that Robinson knowingly endangered others’ lives, given that he had a clear shot and fired only once.
In response, prosecutors countered, stating, “You can’t shoot a rifle into a crowd of 3,000 people and not know that you are posing a significant risk of death.”
Robinson displayed no visible reaction during the arguments. His mother, Amber Robinson, was present in the courtroom, while his father, Matt Robinson, listened attentively with his head bowed. Charlie Kirk’s parents, Robert and Kathryn, entered the courthouse together, along with Erika Kirk, and left the courtroom during a portion of the prosecutor’s argument detailing the shooting.
In addition to the aggravated murder charge, Robinson faces accusations of obstruction of justice, which carries a potential 15-year prison sentence, and felony discharge of a firearm causing serious bodily injury, which can result in a five-year to life prison term, according to the Utah County Attorney’s Office. Judge Graf has ordered Robinson to stand trial on all seven charges against him.
Robinson has not yet entered pleas for these charges.
