New regulations in China now allow the government to impose travel restrictions on citizens considered to be in violation of security and technology export laws. This development occurs amid intensifying competition with the United States in fields such as artificial intelligence and other emerging technologies.

Experts have raised alarms about the scope of these new rules, noting that their language is “vaguely defined and easily adjustable.” Under these regulations, citizens identified as threats to the nation’s “industrial or technological security” may face exit bans.

The updated border control measures, which came into effect on Tuesday, are part of a larger revision of border policies, reflecting the government’s increasing apprehension regarding technology exports in light of competitive pressures from the U.S. The initial statement of the regulation emphasizes its aim to “protect national sovereignty, security, and developmental interests,” as articulated by China’s State Council.

Individuals who engage in illegal activities abroad that jeopardize national security could be barred from leaving China for periods ranging from six months to three years upon their return. Additionally, those who breach technology import or export regulations may also face travel bans if their actions threaten industrial or technological safety.

There is also a provision indicating that foreigners could be prohibited from entering China for one to five years if they provide false information on visa applications or upon arrival.

The new regulations aim to protect citizens from being manipulated into traveling abroad, where they could be coerced into participating in illegal gambling or scam operations, an issue that has persisted in recent years.

The Cyberspace Administration of China, responsible for overseeing online discourse, attempted to alleviate fears that these rules would hinder travel for ordinary citizens. The agency clarified that the regulations are directed at individuals involved in illicit cross-border activities rather than those with legitimate travel purposes.

However, analysts have expressed concern about the broad interpretation of these travel restrictions. Chong Ja Ian of the National University of Singapore highlighted that terms like security and criminal activities can be ambiguously defined, allowing for flexible enforcement. He noted that the implications of these rules will become clearer only when they are put into practice.

Ja referred to the case of Min Zin, a U.S. citizen detained in Yunnan province, as an example of how wide-ranging and potentially arbitrary these restrictions could be. The U.S. government has claimed that her detention was improper, while China has maintained that she is under suspicion for violating local laws.

Dylan Loh, an associate professor at Nanyang Technological University, remarked that these travel restrictions signal China’s commitment to preventing breaches in areas critical to national security and interests. A report from Trivium, a consultancy focused on Chinese policy trends, stated that these regulations exemplify China’s seriousness in blocking the transfer of essential technology and expertise.

The technological rivalry between China and the United States has intensified, with both nations accusing each other of misappropriating advancements in artificial intelligence. Earlier this year, China halted a deal that would have allowed tech firm Meta to acquire the AI startup Manus, citing concerns over the transfer of advanced technology, despite Manus being based in Singapore with Chinese ties.
