Judge William Sullivan has rejected a plea from Lindsay Clancy’s lawyer to declare her not guilty of the murders of her three children, which occurred in 2023, following a mistrial last month.

In his ruling on Thursday, the judge stated that the evidence presented by the prosecution was adequate to warrant the case being presented to a jury.

Kevin Reddington, representing Clancy, had previously submitted a motion for a required finding of not guilty multiple times during the trial, including after both the prosecution and defense concluded their cases. Each request was denied, and following the mistrial due to a hung jury, he renewed his motion in line with standard legal practices.

Reddington contended that the prosecution had not sufficiently demonstrated that Clancy was responsible for the deaths of her children. This assertion surprised many observers, especially since Clancy’s defense team did not dispute the fact that she had committed the acts during the trial. Reddington claimed that an inadequate police investigation resulted in a lack of evidence linking Clancy to the strangulation of her children.

The judge countered this argument, pointing out in his ruling that Clancy was the only individual present in the home when the children were killed, a fact supported by GPS data and surveillance footage that showed her husband, Patrick Clancy, was not at home during the incident.

Additionally, Reddington argued that the prosecution failed to establish whether Clancy was capable of recognizing the wrongfulness of her actions or whether she was suffering from a mental illness at the time of the children’s deaths. However, the judge indicated that this determination should be left to a jury, based on conflicting testimonies from various psychological experts.

Judge Sullivan stated, “The Court finds that the evidence, when viewed in a manner most favorable to the Commonwealth and with reasonable inferences drawn, was sufficient for any rational trier of fact to conclude beyond a reasonable doubt regarding the essential element of the defendant’s criminal responsibility.”

This ruling pertains to a Rule 25 motion, which requires the judge to assess the evidence in a light that favors the Commonwealth of Massachusetts. Legal analysts have commented that such motions typically face significant challenges.

Reddington has also filed a separate motion requesting that the court investigate the conduct of a juror who was the sole holdout during deliberations. Furthermore, the defense has sought to have the case dismissed on double jeopardy grounds ahead of a possible retrial.

The next court hearing is scheduled for November 2.
