CBS News New York has been examining documents related to Cornell University’s Title IX inquiry into an alleged gang rape involving a fraternity.

The documents provide insight into Jane Doe’s account of the events from that night and the following days, as well as the recollections of those around her.

The records consist of interviews with Doe, six of the seven men named in her significant civil lawsuit, and 20 witnesses.

Some of the details contained in the records are graphic and unsettling.

One roommate recounted that the morning after the alleged incident at Cornell’s Chi Phi house in October 2024, Doe expressed disbelief, saying, “Oh my goodness, isn’t that crazy?” The roommate observed that Doe was laughing while sharing her story but appeared to be in a state of shock. Notably, she did not refer to the experience as rape or assault at that time.

A second roommate mentioned that Doe did express discomfort, stating, “I wasn’t comfortable.”

About a week later, this second roommate reported hearing Doe tell one of the men involved, “You had penetrative sex with me. I had so much ketamine, my eyes were crossed, and you still had sex with me.”

These statements are part of the transcripts from Cornell’s Title IX investigation, which were shared with the relevant parties in January 2025. CBS News New York acquired the documents from a source; however, they do not include the minutes, reasoning, or final conclusions from the Title IX panel’s hearings.

During her Title IX interview in November, Doe mentioned that she did not exhibit “excitement and enthusiasm, which is kinda the basis of consent.”

She stated that she communicated to the men that she was tired and wished to stop, but at times felt pressured to consume more substances.

Doe struggled to identify when she lost her capacity to make decisions, mentioning that she quietly told one man she felt uncomfortable.

The men accused of rape and assault also provided their perspectives.

One claimed he asked Doe for permission to take ketamine from her body, to which she supposedly consented.

Another accused, Scott Kretzschmar, stated he was in the room for no more than five minutes, did not see her undressed, and did not partake in any drugs.

Kretzschmar informed a Title IX investigator that he asked Doe if she was alright, to which she replied, “I’m good,” asserting that she did not appear intoxicated.

The lawsuit identifies seven men and outlines various accusations against them, with four specifically charged with rape. Kretzschmar’s allegation involves him allegedly snorting ketamine from Doe’s body, a claim that his attorney, Jeremy Saland, has rejected.

Saland stated, “The process that Cornell had was absolutely biased in my personal experience … biased in favor of her, not these young boys.”

Cornell University indicated that its Title IX process extended over several months, included a hearing with trained faculty and staff, and resulted in disciplinary actions such as expulsions and suspensions.

The gang rape allegations have led to public outrage and scrutiny regarding Cornell University and its police department’s handling of the case.

Initially, the district attorney chose not to file charges, but the investigation has since been reopened.

CBS News New York’s investigative team is continuing to delve into the records.
