Bengaluru Suburban Rail Initiative: K-RIDE Secures ₹57 Crore from Bank Guarantees Amidst L&T Controversy

The Rail Infrastructure Development Company (Karnataka) Limited, known as K-RIDE, has successfully cashed in on performance bank guarantees totaling Rs 57 crore from Larsen & Toubro (L&T) through YES Bank. This action followed an arbitration tribunal’s decision to dismiss L&T’s request to prevent the encashment.

The bank guarantees were associated with civil construction work for Corridors 2 and 4 of the Bengaluru Suburban Rail Project (BSRP). K-RIDE finalized the encashment on April 4, after the tribunal affirmed that L&T had breached its obligations under both corridor contracts and had unlawfully terminated the agreements outside the agreed terms.

The conflict intensified when L&T ended the contracts and secured a stay from a commercial court against the encashment. In response, L&T invoked the arbitration clause, resulting in the establishment of a tribunal consisting of retired judges from the Supreme Court and high courts to assess the claims from both parties. The commercial court subsequently directed that all related issues be handled by this tribunal.

The tribunal’s decision to deny L&T an injunction enabled K-RIDE to proceed with the encashment.

The contention began when K-RIDE was accused of not providing the necessary land, causing L&T to suspend work on two lines since March of the previous year: the 25-km Mallige Line (Bennigenahalli-Chikkabanawara) and the 46-km Kanaka Line (Heelalige-Rajanukunte).

L&T had signed contracts with K-RIDE for Corridor-2 and Corridor-4 on August 26, 2022, and December 12, 2023, respectively. The contract periods were later extended to September 2026 and October 2026 at the contractor’s request.

It is important to note that the Union government approved the 148 km Bengaluru Suburban Rail Project in October 2020, aiming for completion by 2026. Prime Minister Narendra Modi laid the foundation stone in June 2022, nearly a year ahead of the Karnataka Assembly elections. However, the initiative has encountered various challenges, including issues related to land acquisition.
