The Rajya Sabha has declined a motion from the Opposition aimed at the removal of Gyanesh Kumar, following a decision by the Chairman not to admit the request.

The motion, which garnered support from 63 Members of Parliament, was dismissed after a thorough evaluation based on applicable constitutional and legal frameworks.

According to a bulletin released by the Rajya Sabha, “Members are informed that a notice of Motion dated March 12, 2026, endorsed by 63 Members of Rajya Sabha under Article 324(5) of the Constitution of India, in conjunction with Article 124(4), Section 11(2) of the Chief Election Commissioner and Other Election Commissioners (Appointment, Conditions of Service and Term of Office) Act, 2023, and the Judges (Inquiry) Act, 1968, requesting the removal of Shri Gyanesh Kumar, Chief Election Commissioner of India, was submitted to the Hon’ble Chairman of the Rajya Sabha. After careful consideration of the motion and an objective review of all pertinent factors and issues, the Hon’ble Chairman, exercising the authority granted under Section 3 of the Judges (Inquiry) Act, 1968, has opted not to admit the motion.”
