Family of train shooting victim calls for reversal of decision to transfer former RPF officer for additional medical care

A relative of one of the victims from the Jaipur-Mumbai train incident that occurred on July 31, 2023, has requested the court to reconsider its previous ruling regarding the accused, former RPF constable Chetansinh Chaudhary. The court had referred Chaudhary to a mental health facility for treatment in a decision made last month.

The spouse of the deceased passenger, Asghar Ali Abbas Shaikh, submitted a petition to the court on Wednesday, asserting that a District Mental Health Review Board had thoroughly evaluated Chaudhary’s mental state and deemed him mentally competent to face trial.

“This evaluation was presented to this esteemed court on March 24, 2025. Thus, there is no legal or factual justification for a new referral,” the statement indicated. It further noted that Chaudhary had been hospitalized at the Regional Mental Hospital in Thane from February to July 2025, and upon completing his treatment, he was certified as stable. The petition argued, “Since he has successfully undergone the necessary treatment, any further referral is unnecessary and suggests an attempt by the accused to manipulate the judicial system.”

On March 25, the court had instructed that Chaudhary be transferred to the hospital while his bail request remains unresolved, wherein he has claimed to be experiencing “borderline insanity.”

The chargesheet submitted by the Government Railway Police made no mention of any mental health issues concerning Chaudhary.

The petition also highlighted that Chaudhary failed to disclose the review board’s findings in his bail plea, asserting that such omission should be addressed with severity. Additionally, it emphasized that Chaudhary, a “trained law enforcement officer,” is charged with the killings of three unarmed civilians and his superior.

Chaudhary is currently on trial for the alleged murder of his superior, assistant sub-inspector Tikaram Meena, along with the three Muslim passengers: Asghar Ali Abbas, Abdul Kader Bhanpurwala, and Syed Saifuddin aboard the Jaipur-Mumbai passenger train.

“Any ruling that allows for bail or repeated medical evaluations in this matter undermines the quest for justice for the victims. With charges already filed and 18 witnesses having testified, granting bail or delaying the trial for further medical assessment at this stage would significantly hinder the prosecution,” the petition stated, adding that the court had previously reviewed the evidence and denied bail to Chaudhary.
