A Delhi court has placed Amitabh Jhunjhunwala and Amit Bapna, former senior officials of the Reliance ADAG group, in the custody of the Enforcement Directorate (ED) for five days. They are currently under investigation for alleged financial misconduct under the Prevention of Money Laundering Act (PMLA), concerning a purported multi-crore scheme that involved the misappropriation of funds through various group entities.<\/p>\n
This decision by the court follows the late-night apprehension of both individuals by the ED on Wednesday. The agency had requested a 10-day custody period to unravel a complicated network of shell companies purportedly used to siphon off bank loans.<\/p>\n
During the court proceedings, Special Judge Hasan Anzar of Rouse Avenue Court noted that the investigation is still in its early stages, emphasizing the need to clarify each individual’s involvement. He stated, “The evidence at this stage suggests there may be additional individuals entangled in this matter, and we must trace the entire financial trail, which amounts to approximately Rs 11,500 crore, to recover the proceeds of crime.”<\/p>\n
Further, the judge highlighted the necessity for the accused to be confronted with the relevant documents, indicating that a comprehensive understanding of the intricate transactions is essential for the ongoing investigation.<\/p>\n
The allegations against Jhunjhunwala, the former vice-chairman of Reliance Capital, and Bapna, previously the chief financial officer, revolve around the purported misdirection of public funds originating from Reliance Home Finance and Reliance Commercial Finance. The ED asserts that funds approved as loans to various entities were systematically channeled through a network of interconnected companies, many of which allegedly existed merely on paper.<\/p>\n
The agency contends that this manipulation of funds was intended to obscure the actual nature of the transactions and to benefit individuals in senior positions within the corporation, ultimately harming lenders and shareholders.<\/p>\n
Additionally, the ED, represented by Special Public Prosecutor Simon Benjamin, has connected this alleged fraud to a wider inquiry into banking irregularities involving nearly Rs 40,000 crore, with the suspected proceeds of crime exceeding Rs 6,200 crore.<\/p>\n
The court noted, “The ED has shown that after securing loans from various organizations, the funds were funneled into multiple shell companies, which the investigation has identified as being under the influence of the Reliance Anil Ambani Group.”<\/p>\n
