India further asserted that its legal framework is consistent with the labor standards set by the International Labour Organisation (ILO).<\/p>\n
The importance of the Section 301 investigation for India is underscored by comments made earlier this week by US Treasury Secretary Scott Bessent, who indicated that tariffs imposed by the Trump administration could be reinstated by July to levels that existed before they were annulled by the Supreme Court. Although India and the US have reached a preliminary framework agreement, the formal signing of this deal has yet to occur.<\/p>\n
Indian representatives are scheduled to visit Washington next week for negotiations.<\/p>\n
Following an extended period of facing reciprocal tariffs as high as 50%, which were deemed illegal by the US Supreme Court, India articulated on Wednesday that the bilateral trade surplus with the United States is a macroeconomic phenomenon shaped by various circumstances. This statement is notable, as US President Donald Trump previously focused on India and other nations when addressing trade deficits and enforcing substantial tariffs.<\/p>\n
The Ministry of Commerce and Industry highlighted that the US Dollar serves as the primary global reserve currency, dominating transaction volumes and making up 56% of global foreign exchange reserves. This status enables the United States to borrow more easily, facilitating sustained trade deficits primarily due to the dollar’s global reserve currency status.<\/p>\n
The United States Trade Representative (USTR) has contended that structural excess capacity in manufacturing sectors poses a significant challenge to American efforts to bring supply chains back home and create well-paying jobs for US workers. The USTR argues that key trading nations have developed production capabilities that are not aligned with domestic and global demand incentives.<\/p>\n
India countered this claim by stating that the trade surplus is a natural outcome of global trade dynamics and reflects broader economic conditions. The Indian government argued that this surplus is likely to emerge in bilateral trade relationships and that treating it as a unique issue detrimental to US commerce, along with the initiation of Section 301 investigations, undermines the foundational principles of comparative advantage that support international trade. The Ministry also noted that certain non-market economies could play a role in this context, while emphasizing that India, with a smaller trade share with the US compared to other partners, cannot be considered a significant factor in exacerbating the US trade deficit.<\/p>\n
In refuting claims of overcapacity, India maintained that its bilateral trade balance should be understood within the larger framework of its external account position, development requirements, and import patterns. Notably, India’s goods exports represent only 3.1% of total US imports.<\/p>\n
The government stated, “India’s merchandise export-to-GDP ratio of roughly 12% signifies that production is chiefly directed towards domestic consumption, with exports forming a minor part of the overall economic activity. The manufacturing growth in sectors mentioned in the Initiation Notice is fundamentally driven by domestic demand.”<\/p>\n
The Indian government also pointed out that the USTR’s selective focus on specific sectors where India has a global trade surplus does not inherently prove the existence of “structural excess capacity” in those sectors.<\/p>\n
Additionally, India has ratified the Forced Labour Convention of 1930 and the Abolition of Forced Labour Convention of 1957, which mandate the prohibition of all forms of forced labor.<\/p>\n
