McALLEN, Texas — A young father spent five months awaiting the release of his three-year-old daughter from federal custody after she and her mother crossed the U.S.-Mexico border. Throughout this period, he hoped for a swift reunion, but faced numerous delays that ultimately led him to seek legal intervention.<\/p>\n
It was only after turning to the courts that he discovered his daughter had allegedly endured sexual abuse while in a foster home, a situation that arose following her separation from her mother by immigration authorities. \u201cShe was in there for such a long time,\u201d the father, a legal permanent resident, expressed. \u201cI believe that if they had acted more swiftly, this tragedy could have been avoided.\u201d He chose to remain anonymous in order to protect his daughter’s identity as a victim.<\/p>\n
Last year, the administration of President Donald Trump began implementing new policies aimed at detained immigrant children, including the man’s daughter, which resulted in significantly longer detention periods. The federal government also intensified efforts to expand family detention, seeking to revoke key protections for immigrant minors in their custody.<\/p>\n
The father faced numerous obstacles as he tried to reunite with his daughter, with officials claiming they were unable to schedule an appointment for him to provide his fingerprints. During this time, court documents revealed that the girl reported being sexually abused by an older child in her foster home located in Harlingen, Texas. A caregiver noticed that the child was wearing her underwear backward, prompting the girl to disclose multiple incidents of abuse that resulted in bleeding. The Federal Office of Refugee Resettlement (ORR) informed the father that there had been an \u201caccident\u201d and that a medical examination would be conducted.<\/p>\n
\u201cI demanded to know what had happened. As her father, I wanted to be informed about the situation,\u201d he recounted. However, officials indicated that they could not provide further details due to the ongoing investigation.<\/p>\n
The girl underwent both a forensic examination and an interview, but the father was not informed of the findings. Nonetheless, the older child accused of the abuse was removed from the foster program, according to the lawsuit. The allegations were subsequently reported to local authorities, as stated by Lauren Fisher Flores, the attorney representing the child. The Associated Press typically refrains from disclosing the identities of individuals who have reported sexual abuse.<\/p>\n
Fisher Flores remarked, \u201cTo have your child suffer abuse while under government care, without understanding what occurred or how to protect them, is beyond comprehension. Children deserve safety and should be with their parents.\u201d The ORR and its overseeing agency, the Department of Health and Human Services, were named in the lawsuit but did not respond to requests for comment.<\/p>\n
The girl and her mother crossed the border illegally near El Paso on September 16 of the previous year. Following her mother’s arrest for making false statements, the two were separated, and the toddler was placed under the care of the ORR, which provides shelter and foster care for immigrant children.<\/p>\n
Children in ORR custody are released to parents or sponsors who must navigate a rigorous vetting process, which has become increasingly stringent under the Trump administration. New documentation requirements for sponsors were introduced, and border agents began pressuring unaccompanied minors to self-deport prior to their transfer to shelters. Additionally, Immigration and Customs Enforcement (ICE) started arresting some sponsors during the release process.<\/p>\n
Legal advocates have filed lawsuits to contest these policy changes, anticipating that they would lead to extended detention periods. The average time children spent in ORR care soared from 37 days when Trump assumed office to nearly 200 days by February of this year, while the total number of children in ORR custody decreased by about 50% during the same timeframe.<\/p>\n
Attorneys have increasingly resorted to habeas petitions\u2014emergency lawsuits\u2014to expedite the release of children to their parents or sponsors. Fisher Flores noted that this year, the American Bar Association\u2019s ProBar project has filed eight habeas corpus petitions for children who have been detained for an average of 225 days, a step they had not previously taken before the current administration.<\/p>\n
Following the protracted delay, attorneys sent a letter to the government in February, which prompted officials to allow the father to proceed with the necessary appointments for fingerprinting, a home visit, and a DNA test. However, ORR again failed to provide a timeline for the girl\u2019s release. Ultimately, after filing the habeas petition in federal court, the girl was released to her father just two days later.<\/p>\n
It was during the preparation of the lawsuit that the father realized the \u201caccident\u201d referenced by officials was, in fact, alleged sexual abuse. \u201cWe are increasingly compelled to seek intervention from federal courts to contest these harmful legal violations and ensure that children are released,\u201d Fisher Flores stated.<\/p>\n
The fingerprinting policy faced challenges during the first Trump administration, spearheaded by legal advocates, including the National Center for Youth Law. Other lawsuits nationwide are currently contesting more recent changes impacting the custody and care of immigrant children.<\/p>\n
