According to reports from the Guardian, several ministers are collaborating with backbenchers to negotiate additional exemptions regarding Shabana Mahmood’s proposed immigration reforms.<\/p>\n
Keir Starmer is currently seeking feedback on the suggested modifications, which would complicate the process of obtaining settled status in the UK. He is facing internal pressure from party members to clarify that these changes should not apply to individuals who have already settled in the country.<\/p>\n
The new proposal stipulates that individuals would need to wait a decade to qualify for indefinite leave to remain, an increase from the current five-year requirement. The Guardian previously disclosed that Starmer was considering excluding public sector workers and those nearing settled status from these new regulations.<\/p>\n
However, Prime Minister Starmer is being encouraged to take further action to mitigate discontent among backbenchers. A primary request from Labour critics of the plan is to exempt those who have already been in the UK, a sentiment echoed by former Deputy Prime Minister Angela Rayner and others.<\/p>\n
A prominent backbench dissenting voice expressed belief that preventing the changes from being applied retroactively would satisfy most critics. Nonetheless, other members, including Emily Thornberry, chair of the foreign affairs select committee, argue for a comprehensive overhaul of the proposals, particularly concerning the earned settlement aspect.<\/p>\n
“I personally oppose all changes to indefinite leave to remain, but I think most of the group would accept that compromise,” noted another MP.<\/p>\n
Sources from Downing Street indicated that the proposed changes have always been open to consultation, including the retrospective clause, which would require individuals who have entered the UK in the last five years to wait longer for settlement.<\/p>\n
Labour MPs have voiced their frustration over negative briefings directed at Tony Vaughan, the MP for Folkestone and Hythe, who coordinated a letter opposing the measures. A recent article in the Sun criticized his background as a human rights and immigration barrister.<\/p>\n
Attorney General Richard Hermer has reportedly been angered by similar briefings, which the Home Office has denied originating from them. The article included disparaging remarks attributed to an unnamed Labour MP about Vaughan.<\/p>\n
Several MPs expressed that the Home Office has failed to adequately address their concerns. “If you signed the letter, you just get called and yelled at,” one MP remarked. Another reported receiving no acknowledgment for a letter sent to Mahmood over a month ago.<\/p>\n
There is a perception among some MPs that their concerns are being dismissed, especially since the changes do not require a parliamentary vote. London MPs have highlighted how the proposed adjustments to indefinite leave to remain are being featured prominently in Green Party campaign materials, with one leaflet in Islington accusing Labour of penalizing hardworking migrants and positioning the Greens as champions of anti-racism and migrant rights.<\/p>\n
Home Secretary Mahmood has spearheaded the government’s stricter immigration policies in response to the rising influence of Nigel Farage\u2019s Reform UK. Many Labour MPs are worried that the Green Party’s recent success in the Gorton and Denton by-election indicates a significant threat on the left flank of Labour.<\/p>\n
A collective of 100 Labour MPs signed a letter opposing the reforms upon their announcement, arguing, “You don\u2019t restore public trust in the asylum system by threatening to forcibly remove refugees who have lived here lawfully for 15 or 20 years.”<\/p>\n
Sarah Owen, a leading figure in the centre-left Tribune group of Labour MPs, has likened the use of force against children to Donald Trump\u2019s policies involving Immigration and Customs Enforcement (ICE).<\/p>\n
Rayner reiterated many of these sentiments during a speech last month to the Mainstream campaign group, criticizing the changes to settled status. “We cannot discuss earning a settlement if we keep shifting the goalposts,” she stated. “Shifting the goalposts damages our sense of fairness. It\u2019s un-British.”<\/p>\n
In response to inquiries regarding calls for changes to the proposals, a Home Office spokesperson asserted, “The government\u2019s stance remains unchanged. We will always welcome those who come to this country and contribute to our national life. However, the privilege of living here permanently must be earned, not guaranteed.”<\/p>\n
“Between 2021 and 2024, this country has experienced migration levels that historically would have taken four decades. We must be candid about the scale and impact of hundreds of thousands of low-skilled migrants gaining settlement,” the spokesperson added. “The government will extend the route to settlement from five to ten years. As announced in November, we are consulting on applying this change to those currently in the UK who have not yet achieved settled status.
