Previously, the Jan Vishwas (Amendment of Provisions) Act, 2023, had already modified 183 provisions across 42 laws to facilitate a smoother business environment.<\/p>\n<p>This latest Bill expands on those efforts by significantly decriminalizing and refining penalties in a wider array of legal frameworks, thereby influencing aspects of everyday life for citizens in their interactions with the law.<\/p>\n<p>The Bill aims to streamline the penal code by introducing amendments across various sectors, collectively decriminalizing or rationalizing 1,018 actions and omissions that were previously categorized as offences.<\/p>\n<p>In the business sector, modifications are made to laws such as the Tea Act, the Coir Industry Act, and the Legal Metrology Act of 2009.<\/p>\n<p>Regarding local governance, the Bill suggests revisions to the Delhi Development Act, the Delhi Municipal Corporation Act, and the Cantonments Act of 2006.<\/p>\n<p>In the field of transportation and infrastructure, it addresses the Motor Vehicles Act, the Coastal Shipping Act, and the Petroleum and Minerals Pipelines (Acquisition of Right of User in Land) Act of 1962.<\/p>\n<p>The Bill also revises several colonial-era laws, including the Cattle Trespass Act, the Live Stock Importation Act, and the Indian Succession Act, which had continued to utilize criminal law for routine compliance issues.<\/p>\n<p>Overall, the proposed Bill outlines four major categories of changes aimed at reforming the state&#8217;s response to legal violations.<\/p>\n<p>A key feature of the amendments is a clearer differentiation between fines and penalties. Fines, which are imposed by courts and require adherence to the complete criminal justice process even for minor amounts, contrast with penalties that are civil in nature and enforced by designated officers, allowing for more efficient resolution.<\/p>\n<p>The offences that are being decriminalized or modified generally fall into the following categories:<\/p>\n<p>1. Outdated and redundant offences: The Bill removes insignificant or obsolete offences that pose minimal harm. Examples include eliminating penalties for allowing a child under seven to relieve themselves in public or extinguishing lamps. Similarly, offences related to loitering or begging in cantonments and hawking in railway carriages have been decriminalized.<\/p>\n<p>2. General contraventions: Numerous Central laws impose criminal penalties for non-compliance with any provision, which has contributed to overcriminalization. The Bill decriminalizes provisions in about 17 laws and removes them from around five laws. For instance, the Motor Vehicles Act of 1988 now offers a warning for a first-time offence, followed by a penalty for subsequent violations.<\/p>\n<p>3. Procedural defaults: To enhance the business climate, the Bill seeks to decriminalize minor infractions where the underlying conduct is not inherently criminal. For example, under the Tea Act of 1953, it replaces criminal fines for failing to submit returns or providing false returns with a warning for first-time offences and civil penalties for subsequent lapses. This approach applies to around 29 laws, with modifications in six others.<\/p>\n<p>4. Obstruction: The offence of obstructing a public servant is prevalent in various laws, often lacking a clear definition and featuring inconsistent penalties. The Bill aims to decriminalize or remove these offences in approximately 20 laws. For example, the Marine Products Export Development Authority Act of 1972 has eliminated the obstruction offence.<\/p>\n<p>Instead of defaulting to criminalization, the Bill introduces a more systematic and graded enforcement strategy. It allows for warnings and improvement notices for minor or first-time infractions, thereby providing individuals and businesses an opportunity to rectify issues before facing severe consequences.<\/p>\n<p>For instance, under the Delivery of Books and Newspapers (Public Libraries) Act of 1954, prior criminal fines for violations are now replaced with a notice allowing for correction on the first infraction, followed by registration suspension for repeat violations, and permanent cancellation for ongoing non-compliance.<\/p>\n<p>More serious violations, particularly those that pose significant risks to the public, will still incur criminal penalties. However, the Bill seeks to align these penalties with the principle of proportionality.<\/p>\n<p>This approach represents a comprehensive reevaluation of the enforcement framework, prioritizing criminal law for serious offences while acknowledging the impracticality of applying the criminal justice system to trivial violations.<\/p>\n<p>As of December 2024, there were 370 Central laws in effect, encompassing 7,305 criminal offences, of which 5,333 led to imprisonment. Notably, over 74% of these laws did not pertain to core criminal justice issues but regulated various subjects, including taxation and municipal governance.<\/p>\n<p>Thus, the Bill signifies a significant advancement toward creating a more rational criminal law framework.
