The government of the Northern Territory has put forth a proposal aimed at overhauling Australia\u2019s primary online gambling regulator. This regulatory body, the NT Racing and Wagering Commission (NTRWC), currently oversees 52 online bookmakers operating under licenses granted in the territory, primarily for tax benefits, despite functioning without any full-time staff.<\/p>\n
The national organization dedicated to gambling harm prevention has criticized the proposed legislation, labeling it a “kneejerk, reputational response” to a recent investigative program aired by Four Corners. In contrast, the online betting platform Sportsbet has expressed support for the initiative.<\/p>\n
Last month, Northern Territory Attorney-General Marie-Clare Boothby introduced a bill to revise the NT Racing and Wagering Act, which governs the operations of the NTRWC. This commission has been identified as Australia\u2019s de facto online gambling regulator, given its oversight of major betting companies such as Sportsbet, Bet365, and Ladbrokes.<\/p>\n
Allegations of conflicts of interest have emerged following a Four Corners report, which noted that several commissioners have personal ties to the gambling industry. Specifically, six out of the last ten commissioners have had ownership stakes in racehorses, and the chair has reportedly accepted gifts from bookmakers.<\/p>\n
Moreover, the NTRWC has faced criticism for its slow response to complaints lodged by bettors against bookmakers. There are growing calls for the establishment of a national regulator to take over these responsibilities, supported by a 2023 federal parliamentary inquiry that proposed this among 31 recommendations aimed at mitigating online gambling harm.<\/p>\n
However, the federal government’s recent response, revealed by Prime Minister Anthony Albanese, did not include plans for a national regulator, meaning that major online bookmakers will remain under the oversight of the NTRWC.<\/p>\n
Boothby stated that the legislation aims to “modernize governance and licensing” to ensure long-term stability for the industry, safeguard investments, and promote growth in racing and wagering.<\/p>\n
The proposed changes to the NT Racing and Wagering Act were prompted by separate reviews concerning the NT racing sector and the NTRWC’s conflict-of-interest issues. If passed, the amendments would shift the NTRWC\u2019s focus solely to regulating NT-licensed bookmakers, removing its oversight of the territory’s racing and greyhound industries.<\/p>\n
Additionally, the bill would introduce new conflict-of-interest regulations that would prevent NTRWC commissioners from having betting accounts or owning racehorses. Commissioners would also be required to disclose any interests that might conflict with their duties to the NT racing minister within ten days.<\/p>\n
After its introduction, the bill was referred to the NT Legislative Scrutiny Committee, which allowed an eight-day period for public feedback, resulting in six submissions, most advocating for amendments to the bill.<\/p>\n
The Alliance for Gambling Reform (AGR) criticized the proposed legislation, asserting it was not a sincere attempt at reform but rather a reactive measure due to increased scrutiny from Four Corners. Their submission argued that the NTRWC should be transformed into a fully funded, full-time regulatory body supported by existing NT government wagering revenues. They also called for a public registry of commissioners’ interests and transparency in the commission’s complaint-handling process.<\/p>\n
Conversely, only two submissions, from Sportsbet and the Australian Christian Lobby, advocated for the bill to pass without changes. Sportsbet’s submission asserted that the amendments enhance governance, protect the integrity of racing oversight, and ensure the regulatory framework operates effectively. They welcomed the government’s proactive approach to these issues, emphasizing the importance of maintaining confidence in the racing industry.<\/p>\n
