The 72-year-old was apprehended after residing in Australia for over three decades, during which she worked as a nanny in the eastern suburbs of Sydney. She has consistently denied the accusations against her.<\/p>\n
Rivas, a former nanny in Bondi, faced a setback in her legal efforts to prevent extradition to Chile, where she is accused of participating in the kidnapping, torture, and disappearance of seven individuals during the Pinochet era in the 1970s.<\/p>\n
Following her arrest in February 2019, Rivas initiated a lengthy legal battle to fight the extradition order. In her final appeal, she contested a decision made by the Minister for Finance, which marked the last step in the extradition process under the Judiciary Act.<\/p>\n
Her legal representatives argued that this decision was flawed due to jurisdictional errors. They contended that the offenses in question should be classified as crimes against humanity, a designation that was not recognized under Chilean or Australian law at the time the alleged acts occurred. As a result, they claimed that a critical condition of the extradition treaty between the two nations could not be fulfilled.<\/p>\n
Additionally, they presented a secondary argument claiming that the minister neglected to consider the risk of Chile violating treaty obligations if the offenses were categorized as crimes against humanity, which could significantly impact sentencing and the statute of limitations.<\/p>\n
However, Justice Michael Lee dismissed her appeal this morning, stating that the indictment and extradition documents consistently identified the alleged conduct as aggravated kidnapping. He noted that these terms were articulated in standard legal language and were directly connected to specific victims and case numbers within the Chilean legal system.<\/p>\n
In his ruling, Justice Lee remarked, “The applicant’s reliance on selective excerpts from the extradition materials, including the supporting background report from the Supreme Court of Chile, to argue that the offenses should be classified as crimes against humanity is, with respect, misguided.”<\/p>\n
He clarified that references to crimes against humanity were contextually distinct and reflected an assessment for Chilean domestic law purposes concerning the legal implications of the alleged conduct, including limitations on prosecution and potential penalties.<\/p>\n
