The war crime allegations surfaced publicly in 2018 when Nine newspapers published a series of investigative reports detailing several operations in Afghanistan involving the former Special Air Service Regiment (SASR) corporal. Following years of legal disputes, exorbitant court expenses, and a Federal Court trial that spanned over 100 days, the Victoria Cross awardee ended up with a civil ruling that branded him a war criminal rather than the vindication he sought. Justice Anthony Besanko determined that there was significant truth, based on the balance of probabilities, to the claims that he was either directly responsible for or complicit in the deaths of four Afghan detainees.<\/p>\n
The current criminal case presents a more stringent standard of proof\u2014beyond a reasonable doubt\u2014compared to the civil trial. Mr. Roberts-Smith has repeatedly denied any wrongdoing, labeling the allegations as malicious and unfounded. He attempted to appeal the civil ruling, but three Federal Court judges concluded that the original judgment was well-reasoned and free of legal errors. Last September, his last opportunity to challenge the defamation ruling was extinguished when the High Court declined to hear his case.<\/p>\n
As the legal battles over defamation unfolded, the Office of the Special Investigator and the Australian Federal Police (AFP) launched a joint and intricate investigation. Upon Mr. Roberts-Smith’s arrival in Sydney from Brisbane on Tuesday, law enforcement was present, and footage released by the AFP showed him walking alongside investigators, his face obscured but his height and tattoos clearly identifiable.<\/p>\n
The specifics of how the evidence presented in the defamation trial will relate to the criminal case remain uncertain. AFP Commissioner Krissy Barrett indicated that Mr. Roberts-Smith is accused of involvement in the deaths of Afghan nationals from 2009 to 2012 under circumstances that violate the Commonwealth Criminal Code regarding war crimes. It is alleged that the victims were detained, unarmed, not engaged in combat, and under the control of Australian Defence Force (ADF) members when they were killed. Commissioner Barrett stated, “It will be alleged that the victims were shot by the accused or by subordinate ADF members acting on the orders of the accused.”<\/p>\n
She characterized the investigation as complex, thorough, and detailed, but declined to disclose how Mr. Roberts-Smith reacted during his encounter with authorities at the airport. Instead, she addressed the broader defence community, emphasizing that the alleged actions related to these charges involve only a small fraction of the ADF, which she noted is largely made up of individuals who serve the country with honour and dedication. She called for support for the ADF and urged mindfulness for the families of those who have died in service.<\/p>\n
This marks only the second instance where such a collaborative investigation has led to criminal charges against an ADF member. Ross Barnett, Director of Investigations for the Office of the Special Investigator, referred to the charges as a “significant step” resulting from careful and professional investigative efforts. When questioned about the timing of the charges, he mentioned that various operational considerations influenced the decision.<\/p>\n
The investigation is part of a broader effort, comprising over 50 inquiries into alleged war crimes in Afghanistan, with 39 of those cases concluded. Mr. Barnett explained that these investigations pose unique challenges due to their unconventional nature, given the allegations arise from a war zone located about 9,000 kilometers from Australia, which is no longer accessible. Investigators face numerous obstacles, including limited access to crime scenes, lack of photographic evidence, measurements, and the absence of post-mortem examinations.<\/p>\n
