A division bench of the Delhi High Court has rejected a request from Christian Michel James, an accused in the AgustaWestland VVIP helicopter case, for his release from custody, citing breaches of the extradition treaty.<\/p>\n
Judges Navin Chawla and Ravinder Chawla delivered the judgment in an open court session, declaring that the request lacked substantial grounds for approval. A comprehensive written order is anticipated.<\/p>\n
James, who is allegedly acting as a middleman, faces accusations of bribing Indian military and civilian officials, as well as politicians, to facilitate a deal worth Rs 3,600 crore for the procurement of 12 VVIP helicopters from AgustaWestland.<\/p>\n
In November 2025, James contested a trial court’s decision that denied his release despite him securing bail. The court concluded that he could not be granted the benefit of release after serving the maximum sentence allowed under the law, as he is charged with offenses under Section 467 of the Indian Penal Code (IPC), which pertains to forgery of valuable securities and carries a potential life sentence.<\/p>\n
James was extradited from the United Arab Emirates in December 2018, under a treaty with India, facing allegations related to IPC sections 120B (criminal conspiracy) and 415 and 420 (cheating), with these offenses carrying a maximum penalty of seven years of imprisonment.<\/p>\n
In his plea, James contended that Article 17 of the extradition treaty prohibits prosecution for crimes that were not the basis for his extradition.<\/p>\n
He also claimed that, according to the treaty’s stipulations, he should not be tried for violations of IPC Section 467 or the Prevention of Money Laundering Act (PMLA), as these charges were not mentioned during his extradition process.<\/p>\n
James noted that by December 4, 2025, he had completed seven years in custody as an undertrial, which corresponds to the maximum penalty for the charges under which he was extradited.<\/p>\n
In an affidavit submitted on January 8, the Central Bureau of Investigation (CBI) argued that Article 17 of the extradition treaty provides the authority to prosecute James for related offenses and all charges associated with the extradition request. It emphasized that the applicability of these charges should be determined during the argument phase regarding the charges, while the trial is still in the document review stage.<\/p>\n
The Enforcement Directorate (ED), in its affidavit also dated January 8, supported this position, asserting that there has been no breach of the treaty’s terms and requested the dismissal of James’ petition, arguing that there is no prohibition against prosecuting him for the allegations in question.<\/p>\n
