Koby Weaver has been sentenced to prison for his involvement in an attack that resulted in serious injuries to an off-duty police officer. Alongside his co-defendants, Danai Deneiderhavsein and Finley Goodwin, Weaver pleaded guilty to the assault, although Deneiderhavsein and Goodwin received lighter penalties and will not serve additional time in custody.<\/p>\n
Weaver, aged 21, has been given a maximum sentence of two years, with the possibility of parole starting in February next year. His sentence was backdated to account for time he had already spent in custody. He faced the most severe charges of the group related to a violent altercation that occurred on Newtown’s bustling Enmore Road in January of the previous year, involving two off-duty officers who were strangers to the assailants.<\/p>\n
While all three defendants acknowledged their roles in the incident, the court spared Deneiderhavsein and Goodwin from further incarceration. Instead, both were fined $2,200 and allowed to complete their sentences for assault under strict community service conditions.<\/p>\n
The incident unfolded as the two victims were among a crowd heading to the train station after a concert. Initial tensions escalated into physical confrontations involving pushing and shoving, which eventually led to a more violent exchange of punches and kicks. Despite efforts to disengage, the situation deteriorated, culminating in a severe attack.<\/p>\n
According to the court, Deneiderhavsein was heard provoking the victims with aggressive remarks. The confrontation spilled onto the road, where one victim found himself on the ground clinging to Goodwin’s collar. At that moment, Weaver intervened with a violent stomp to the victim’s head before fleeing the scene.<\/p>\n
Judge Greg Grogin condemned Weaver’s actions as “deplorable,” emphasizing the danger posed to others. He noted the severity of Weaver’s behavior during the sentencing, which was supported by video evidence capturing the incident, including a disturbing sound when Weaver stomped on the victim’s head. The officer sustained significant injuries, including fractures to the face.<\/p>\n
Weaver’s defense attorney, Jane Sanders, argued that her client was caught in a rapidly escalating situation and believed his friend was at risk. She acknowledged that Weaver’s response was excessive and reckless but pointed out that he initially attempted to de-escalate the situation. Despite having spent 65 days in custody before being granted bail, Sanders described his behavior post-release as exemplary, noting that his employer welcomed him back even after his guilty plea.<\/p>\n
Goodwin’s attorney, Tomislav Bicanic, shared that his client had sought psychiatric treatment and was managing symptoms of ADHD, which he claimed had positively influenced Goodwin’s life. Goodwin had also spent roughly two months in custody. Meanwhile, Deneiderhavsein, who had just turned 18 prior to the incident, was in custody for nearly six months before being released on bail.<\/p>\n
Deneiderhavsein’s lawyer, Timothy Scott, argued that his client\u2019s involvement in the altercation was minimal and that the initial aggression came from the victims themselves. Each defense attorney highlighted their clients’ lack of prior convictions, family support, expressions of remorse, and youth, contending that the circumstances did not warrant a prison sentence.<\/p>\n
However, Crown solicitor Alexandra Bova argued against the leniency, citing the shocking nature of the video evidence and the unprovoked, random assault on the victims. She remarked that such incidents of street violence are often perpetrated by young men, frequently under the influence of alcohol, and are becoming increasingly common.<\/p>\n
Judge Grogin remarked on the collective behavior of the defendants, stating they acted as a group to assault two innocent men.
