Sources indicate that ministers are ready to confront opposition from critics who label these efforts as “treasonous,” particularly concerning the authority granted in a forthcoming EU-UK reset bill.

In light of the ongoing tensions stemming from the conflict with Iran, which have revealed the vulnerabilities in the UK’s historically special relationship with the United States, government representatives argue that this legislative approach could inject billions into the UK economy. They believe this strategy could mitigate the financial impacts of the conflict and enhance the country’s lagging productivity levels.

The new legislation will implement a trade agreement for food and beverages with the EU and will include provisions that allow the UK government to align dynamically with EU regulations in areas where prior agreements exist. Importantly, this would permit the swift adoption of evolving single market rules deemed beneficial for national interests, bypassing the need for comprehensive parliamentary oversight each time.

This legislative maneuver is facilitated by what are known as Henry VIII powers, named after a 1539 statute that permitted the monarch to enact laws by decree. These powers enable ministers to enact regulations without extensive parliamentary examination through secondary legislation.

The bill is designed to activate ongoing negotiations concerning food, drink, and emissions trading, as well as to adapt to future changes in EU regulations affecting these sectors. However, sources reveal that if the legislation, expected to be introduced before summer, is enacted, it could lead negotiators to adopt EU standards across various sectors, including automotive and agriculture, through secondary legislation.

While Parliament retains the ability to approve or reject secondary legislation, it cannot modify it, which might result in Members of Parliament merely “rubber-stamping” agreements without in-depth debate. Any attempts to block such votes could complicate relations with the EU and potentially lead to retaliatory measures. One official emphasized, “We are committed to ensuring that Parliament will play a role in new agreements and any new EU regulations applied under those agreements.”

This broad delegation of powers is likely to lead to friction with opposition parties. Although it is improbable that the bill will be defeated in the House of Commons, it could face challenges in the House of Lords.

Ministers assert that this legislative approach will facilitate trade without violating the government’s established boundaries regarding re-entry into the customs union, single market, or the restoration of free movement. Critics, however, contend that it could effectively lead to “integration with the EU by stealth” without the voting rights or veto power associated with EU membership.

Professor Anand Menon, director of the think tank UK in a Changing Europe, stated, “Changes to UK regulations should be subject to parliamentary debate and discussion. The reality is that we are agreeing to a deal with the EU that obligates us to adhere to their regulations, regardless of our preferences. The risk is that this leads to covert integration with the EU.”

Menon acknowledged the complexities faced by the government if every alignment with regulations required debate, characterizing it as “the difficult compromise of Brexit.” He noted that this represents a trade-off between political autonomy and economic access without having a voice in negotiations.

Government representatives argue that the proposed bill will reduce bureaucratic hurdles and costs for businesses, expediting the implementation of agreements in areas such as food and beverage, automotive, and security information sharing. They indicated that any regulatory disputes would be resolved by independent tribunals rather than EU courts.

While Nigel Farage’s Reform UK party has concentrated on immigration and environmental policies in anticipation of the upcoming elections in Scotland, Wales, and England, insiders suggest that the government is prepared to engage with staunch advocates of a hard Brexit.

One government insider remarked, “We anticipate resistance from those who favor a stringent exit from the EU. They may accuse us of treason, but all international agreements necessitate shared regulations. Historically, the most pragmatic free traders and conservatives have recognized this necessity. However, Nigel Farage lacks the courage to negotiate with the EU.”

Officials also noted that this legislative initiative reflects an acknowledgment of the significance of the UK’s trading relationship with the EU and recognizes the economic repercussions of Brexit. The Office for Budget Responsibility has projected a long-term productivity decline of 4% and a 15% reduction in both exports and imports relative to remaining within the EU, as indicated in their latest March 2025 forecast.

They stated, “The EU is our largest trading partner, with nearly half of our total trade conducted with EU nations in 2024. We all face a cost of living burden due to border barriers, making it prudent to negotiate agreements to eliminate these obstacles and address the damage, while still adhering to our commitments against rejoining the customs union, single market, or restoring free movement.”

Since the announcement of the “reset” deal last May following the inaugural UK-EU summit, Keir Starmer’s government has aimed to strengthen diplomatic and economic relations with the EU. Earlier this month, the Prime Minister highlighted the UK’s intent to pursue a deeper partnership in trade and defense with the EU, citing the instability caused by the conflict with Iran and acknowledging that Brexit has inflicted “significant harm” on the UK economy.

The Conservative Party has previously stated its commitment to ensuring that all details of negotiations with the EU undergo thorough parliamentary scrutiny, while the Liberal Democrats plan to utilize any such bill to compel Labour MPs to clarify their stance on closer relations with the EU.

Government officials are preparing to significantly alter the United Kingdom’s engagement with the European Union through proposed legislation that may enable the UK to adopt EU single market regulations without undergoing the standard parliamentary voting process.
