The Supreme Court of Victoria is currently adjudicating a legal conflict regarding the ownership of a dilapidated residence once belonging to one of Australia’s most renowned artists, Frederick McCubbin. Located in the Macedon Ranges, the property, known as Fontainebleau, served as McCubbin’s creative retreat where he produced some of his most celebrated artworks.<\/p>\n
The ongoing dispute centers around a claim for adverse possession, which is presently under evaluation by Land Use Victoria. Fontainebleau, a substantial two-storey timber and fibro structure featuring 30 rooms, is situated about an hour’s drive north of Melbourne. It was the sole property owned by McCubbin during the early 1900s.<\/p>\n
During court proceedings, it was revealed that the property is in a critical state of disrepair, displaying signs of “black mould, vermin infestations, and wheelie bins filled with rainwater.” The legal battle involves the owners of Fontainebleau, who have been instructed by the court to vacate the premises, and the individual who has occupied and maintained the property for the past 22 years.<\/p>\n
Fontainebleau has been registered on the Victorian Heritage Register since 2010, recognized for its architectural and historical significance. The current ownership includes five joint proprietors, among them brothers Paul and Mark Cutler.<\/p>\n
The court was informed that Trevor Hoare, the caretaker, has been residing at Fontainebleau based on an agreement with Mark Cutler established in March 2004. Hoare has since applied for adverse possession on two occasions: first in November 2025, which was later withdrawn, and again in February this year. Adverse possession laws permit individuals to claim ownership of land after maintaining uninterrupted, exclusive, and unauthorized possession for a minimum of 15 years.<\/p>\n
Hoare’s attorney, Kieran Hickey, asserted that his client, an elderly pensioner, has dedicated his resources and effort to the property’s maintenance. Hickey emphasized, “He considers it his home, and his adult children visit him regularly. He has not resided anywhere else, except due to family and health circumstances last winter.” Furthermore, the court learned that the locks on the property were changed in March at the request of Paul Cutler, shortly after Hoare had secured the premises.<\/p>\n
Timothy Sowden, representing the Cutler brothers, noted that Paul Cutler had contacted Hoare in February after becoming aware of the adverse possession claim, subsequently rescinding Hoare’s permission to remain at Fontainebleau. “It was a mutual arrangement with no clear victor,” Sowden remarked.<\/p>\n
Associate Justice Ian Irving mandated that Paul Cutler must provide Hoare with access to the property and deliver all keys by April 8. Reports indicate that Heritage Victoria requires the owners to recruit a heritage consultant for an inspection and a proposed schedule of works by February of this year, although an extension was granted due to the ongoing legal situation. Sowden mentioned that the property must be rendered “safe to walk through,” with biohazard cleanup projected to cost around $60,000.<\/p>\n
Under the court’s directive, Hoare is obligated to permit Heritage Victoria access for inspections and urgent repairs. His lawyer added, “Mr. Hoare is not obstructing Heritage Victoria’s efforts. In fact, he initiated a heritage claim application himself.” The case is set to return to court in August while the adverse possession application is analyzed by Land Use Victoria.<\/p>\n
Dr. Anna Gray, the former head of Australian art at the National Gallery of Australia, highlighted McCubbin’s relocation to the countryside in 1901, motivated by the need for fresh air to alleviate his wife Annie’s pneumonia. McCubbin frequently visited Fontainebleau on weekends and holidays while continuing to teach in Melbourne.<\/p>\n
Dr. Gray noted that McCubbin created many of his well-known pieces at Fontainebleau, including “The Pioneer,” inspired by the local landscape. She expressed the importance of preserving artists’ homes, stating, “Australia lacks sufficient sites that commemorate the lives of significant figures.” She emphasized the value of visiting locations where artists lived and worked to gain insight into their creative processes.<\/p>\n
After McCubbin’s death at the age of 62 in 1917, his family continued to reside at Fontainebleau. Historical records indicate that the property served as a guest house in the mid-20th century before reverting to private ownership.
