The draft aims to encompass the entire digital news landscape, including user-generated content related to “news and current affairs,” which has sparked apprehension that influencers and smaller creators may be treated similarly to traditional publishers.<\/p>\n
Industry experts point out that the primary issue lies in the potential impact on the creator economy. By imposing compliance standards akin to those for publishers, along with heightened expectations for content removal and mandatory government oversight, these rules could lead to widespread self-censorship, limit the reach of news-driven creators, and deter brands from collaborating with independent voices. Such developments could fundamentally disrupt, or even diminish, India’s rapidly expanding digital news creator ecosystem.<\/p>\n
The right to free expression is one of the most significant rights held by citizens across the spectrum and plays a crucial role in holding authorities accountable. However, this digital public sphere now faces the risk of being constricted. By extending the regulatory scope to include individual contributions on “news and current affairs,” the proposed amendments to the IT Rules may transform everyday discourse into a compliance obligation, raising concerns about a quieter and more cautious online environment.<\/p>\n
A major reason these proposed regulations have attracted significant scrutiny is the perception that the government, particularly through the Ministry of Information and Broadcasting, aims to gain control not only over the content shared but also over the individuals sharing it.<\/p>\n
This concern leads to a critical question regarding the underlying motives of the new proposals. If the intention is to address misleading or inappropriate online content, the government already possesses the authority to block such content at both central and state levels\u2014authority that has been heavily utilized in recent months. Section 69 (A) of the IT Act grants the IT Ministry the power to issue blocking orders, a capability that could extend to various ministries, as previously reported by The Indian Express. Additionally, Section 79(3)(b) allows numerous central ministries and state governments to issue blocking directives to platforms.<\/p>\n
In recent months, numerous videos, many of which could be deemed legal, have faced blocking actions, even when they were merely satirical. A notable example is a short video by stand-up comedian Pulkit Mani; although it has been repeatedly taken down, it continues to circulate as users reshare it.<\/p>\n
While the government attributes the increase in content blocking primarily to deepfakes and financial misinformation, censorship in India remains fundamentally a political instrument.<\/p>\n
The new regulations would allow the government to exercise a different form of control and could also threaten online anonymity. Under these proposals, authorities would be able to obtain information about any user posting content related to news and current affairs, regardless of whether they are professional journalists. An ‘Inter-Departmental Committee’ would be tasked with reviewing content referred by the Ministry of Information and Broadcasting and could recommend actions such as requesting apologies from creators, mandating content modifications, or demanding complete removals.<\/p>\n
Importantly, this could apply to user-generated content created in a non-professional context. The Ministry of Information and Broadcasting would have jurisdiction over what creators can express. Experts believe this could cover nearly all content related to news and current affairs, from satirical commentary on current events to fact-checks conducted by users on platforms like X through its \u2018Community Notes\u2019 feature. In essence, any sharing of news links or commentary on a news event could fall under the purview of these regulations.<\/p>\n
This situation could foster a psychological tendency toward self-censorship. Average individuals often lack the resources or determination to challenge government authority, making the fear of repercussions for expressing dissenting opinions very real. Tech companies internally speculate that if these regulations are enacted in their current form, they will lead to users preemptively censoring themselves. This would result in a significantly less dynamic online environment, ironically countering the government’s stated aim of promoting the so-called \u2018orange economy.\u2019<\/p>\n
Consequently, opposition to these regulations is unlikely to be led by tech companies, which, with few exceptions, have generally refrained from publicly critiquing government policies in India\u2014 a stark contrast to their approach in other regions.<\/p>\n
Many within the tech community view the draft IT Rules as a revival of the government\u2019s unsuccessful efforts to advance the Broadcasting Services (Regulation) (BSR) Bill, 2024, which the Ministry of Information and Broadcasting was previously developing in secrecy with select stakeholders. This bill aimed to broaden the ministry’s jurisdiction from OTT content and digital news to include social media accounts and online video creators, define \u201cdigital news broadcasters\u201d broadly, require government registration, and set standards for content assessment.<\/p>\n
Ultimately, the Ministry of Information and Broadcasting withdrew the draft BSR Bill following controversy and criticism regarding fears of increased governmental control over online content. The draft had raised numerous questions about freedom of speech and the extent of government authority to regulate it.
