The National Consumer Disputes Redressal Commission (NCDRC) has reaffirmed a ruling made by the West Bengal State Consumer Commission, which awarded a compensation of Rs 5 lakh in a case of medical negligence. The NCDRC underscored the responsibility of medical professionals to deliver quality care, including accurate diagnoses and suitable treatments.<\/p>\n
This decision was made by a panel comprising Dr. Inderjit Singh and Dr. Justice Sudhir Kumar Jain, in response to an appeal from Dr. Ranjan Sarkar, a nephrologist based in Kolkata. Dr. Sarkar contested the State Commission’s finding of negligence related to the treatment of his wife, who died during her medical care.<\/p>\n
The commission stated, \u201cIt is the responsibility of doctors to provide high-quality and ethical medical services, which encompasses diagnosing illnesses and administering appropriate treatments. A physician is expected to execute recognized medical procedures with diligence and care, while also educating patients about their health status.\u201d This comment was made on April 7, as the appeal was rejected.<\/p>\n
Furthermore, the commission emphasized the importance of attentive and deliberate patient care, noting that the complainant’s wife passed away due to cardiac arrest, which resulted from the physician’s failure to perform timely blood transfusions despite a rapid decrease in her hemoglobin levels.<\/p>\n
The commission delineated two key aspects of negligence in this case. It found that the decision to delay administering the antibiotic Vancomycin was not considered negligent since physicians have the discretion to select treatments based on their clinical evaluations. However, the commission deemed the delay in blood transfusion as unjustifiable and negligent, highlighting the absence of a convincing rationale given the patient’s deteriorating condition.<\/p>\n
The case revolves around the death of a 67-year-old woman with chronic kidney disease related to Type-2 diabetes, who was under treatment at AMRI Hospital in Kolkata, where Dr. Sarkar oversaw the dialysis department. In early 2017, the patient developed a serious infection and was prescribed Vancomycin by another doctor on January 31, 2017. However, the antibiotic was not administered during subsequent dialysis sessions under Dr. Sarkar’s care.<\/p>\n
The commission meticulously analyzed the timeline leading to the patient\u2019s death. On March 14, 2017, her hemoglobin levels fell to 6.7 g\/dl, yet no immediate transfusion was recommended. By March 24, her levels had further decreased to 5.3 g\/dl, indicating a critical state, but a blood transfusion was only conducted on March 28. The patient ultimately died on April 3, 2017, from cardiac failure.<\/p>\n
The deceased’s husband claimed that the delays in both blood transfusion and antibiotic administration contributed to her death. An investigation by the Chief Medical Officer of Health in Barasat confirmed the delays in transfusion despite the alarming decline in hemoglobin levels.<\/p>\n
Expert assessments indicated that while the choice of antibiotics could be subject to clinical judgment, timely medical intervention, particularly in cases of severe anemia, was crucial and notably absent in this situation.<\/p>\n
Reiterating established principles, the commission remarked that medical negligence is defined by three elements: duty of care, breach of that duty, and resultant harm. The commission clarified that while doctors are not liable for every unsuccessful outcome, failure to act promptly in critical situations falls short of the expected standard of care for a competent medical practitioner.<\/p>\n
The West Bengal State Consumer Disputes Redressal Commission had previously ordered Dr. Sarkar to pay Rs 5 lakh in compensation along with Rs 20,000 for legal costs and interest for non-compliance. The NCDRC upheld this decision, deeming it fair and reasonable, while dismissing the appeal from Dr. Sarkar.<\/p>\n
This ruling reinforces the notion that although medical practice involves professional judgment, the delivery of timely and attentive care is essential and cannot be compromised. By holding the physician accountable for the delays in intervention, the commission highlighted that in critical care scenarios, inaction can be as detrimental as making incorrect decisions, especially when a patient’s life is at stake.<\/p>\n
