This week, testimonies from witnesses regarding the alleged deadly assault of 22-year-old Cameron Duce have been presented in Southport Magistrate Court.<\/p>\n
During the proceedings, it was revealed that one witness initially pointed to a different individual, rather than the accused, as the person responsible for the alleged fatal attack.<\/p>\n
The hearing aims to establish whether sufficient evidence exists for the case to advance to trial, with proceedings set to continue on Wednesday.<\/p>\n
The court has been informed of differing accounts from witnesses regarding who inflicted the lethal blow during a brawl on the Gold Coast that resulted in Mr. Duce’s death.<\/p>\n
Austin Lewis Blaney Ballard is undergoing a committal hearing at Southport Magistrates Court, facing charges of unlawful striking causing death. Authorities claim that he kicked Mr. Duce early in the morning on September 22, 2024, in the vicinity of the Burleigh Heads nightlife area.<\/p>\n
Mr. Duce sustained critical head injuries and succumbed to his injuries a week later while receiving treatment at a hospital.<\/p>\n
In court on Tuesday, Mr. Ballard\u2019s defense attorney, Scott Lynch, interrogated ten witnesses, most of whom were returning along the Esplanade toward First Avenue after an evening out.<\/p>\n
Witnesses recounted witnessing around six altercations involving approximately 30 individuals that morning.<\/p>\n
The court heard that Seth Wynd, in a statement made to police shortly after the event, described a second man\u2014distinct from Mr. Ballard\u2014who “unexpectedly performed a full 360-turn, using his right foot to strike the side of [Mr. Duce’s] face.”<\/p>\n
In a subsequent statement made two weeks later, Mr. Wynd specified the Instagram account of this other man. However, during Tuesday’s court proceedings, he admitted to having made an error.<\/p>\n
“The day Austin [Ballard] was charged is when I realized I had been mistaken,” he stated in court.<\/p>\n
The court noted that Mr. Wynd did not amend his previous statements to the police prior to the ongoing hearings.<\/p>\n
Mr. Lynch probed witnesses regarding whether they observed a “dark-skinned” or “Maori” man\u2014who matched the description of the second individual initially mentioned by Mr. Wynd\u2014participating in the altercations.<\/p>\n
Witness Callum Wilkins testified that he was picking up friends, including the man whose social media account was linked to the investigation, when a water bottle was thrown at his vehicle.<\/p>\n
Wilkins recounted that his friends became embroiled in a fight, though he did not witness anyone being knocked down.<\/p>\n
After the confrontation dissipated and his group headed to the casino, Wilkins noted that the man appeared to have bloodied or injured hands. However, another witness present, Fletcher Bleakley, disputed this, stating, “I don’t remember them being bad.”<\/p>\n
Witness Eli Wilson reported seeing a fight erupt between his group and another group shortly after 2 a.m. He recalled hearing a “thump” before noticing Mr. Duce on the ground, but did not see anyone matching the second man’s description in the vicinity.<\/p>\n
Mitchell Davis, who acknowledged knowing Mr. Ballard from school, claimed he had his back turned when Mr. Duce was allegedly hit. He was around 15 meters away and stated he did not see Mr. Ballard nearby, as his focus was on the individual on the ground. He also mentioned not seeing a “dark-skinned” person in the area.<\/p>\n
On Monday, residents living nearby testified that they observed a man being kicked before he fell to the ground.<\/p>\n
