The Australian Securities and Investments Commission (ASIC) has announced an investigation into certain individuals associated with Sanjeev Gupta’s industrial enterprise, which has recently faced significant turmoil. Three companies tied to Gupta’s operations have failed in Australia, leaving many employees uncertain about their future.<\/p>\n
Last year, the South Australian government intervened and placed the financially troubled Whyalla steelworks into administration. The Tahmoor Coal mine in New South Wales and the Liberty Bell Bay manganese smelter in Tasmania have also succumbed, contributing to the decline of Gupta’s GFG Alliance.<\/p>\n
Creditors are reportedly owed substantial sums, and Greg Dawson, one of over 200 workers affected at the Liberty Bell Bay smelter, expressed his concerns about the uncertainty surrounding their jobs. “Many of us have been part of this site for decades, building friendships and community,” he told the program 7.30, adding, “There’s a lot of stress among the workers.” <\/p>\n
ASIC has faced criticism for its perceived delay in addressing financial warnings related to these businesses. However, the regulator has confirmed that it is actively pursuing multiple investigations into “entities and individuals” linked to Gupta’s conglomerate. In a statement, ASIC refrained from discussing the specifics of these inquiries, noting that it has acted decisively against the intricate network of private firms involved.<\/p>\n
Professor Jason Harris, who teaches corporate law at Sydney University, characterized the failures of these three companies as among the most severe financial collapses. He welcomed ASIC’s investigation, pointing out that the situation had been deteriorating for years under the watch of both regulators and industry stakeholders. “When issues recur so frequently, it raises the question of accountability,” he remarked.<\/p>\n
While ASIC did not disclose details regarding its broader investigations, Harris suggested that it should scrutinize whether the companies were aware of their inability to meet financial obligations. “ASIC should question Gupta and his management about their awareness of the companies’ potential insolvency,” he stated, indicating that there may have been breaches of directors’ duties in these company operations.<\/p>\n
Mark Bryant, a former contractor at the Tahmoor coal mine, echoed the demand for accountability, expressing disbelief over the rapid decline of the mine from profitability to liquidation within a short span. “To see such a successful operation falter within 18 months is incomprehensible. Where did the money go?” he questioned. The mine was declared in liquidation last month, with liabilities exceeding $400 million, including significant claims from related parties, resulting in layoffs for up to 238 employees.<\/p>\n
Bryant reflected on Gupta’s initial reputation as a “saviour” for the industry, stating that his opinion of the businessman has drastically shifted. “If he is still in Australia, he should be expelled,” he declared, suggesting that Gupta should liquidate his assets, including his prominent Sydney residence, to settle his debts and leave. “In my view, he is not welcome here.” <\/p>\n
In response, a spokesperson for GFG conveyed Gupta’s regret over the consequences faced by employees and their families, asserting that the Whyalla, Tahmoor, and Liberty Bell Bay operations were all “significantly distressed assets” when acquired. The spokesperson claimed that considerable resources and leadership efforts had been dedicated to maintaining these businesses, which were provided with every opportunity for recovery.<\/p>\n
The spokesperson also highlighted that the government’s decision to place the Whyalla steelworks into administration had a detrimental ripple effect on other operations, complicating efforts to stabilize the business. Following the administration announcement in February of the previous year, KordaMentha, the appointed administrators, reported that the facility was losing approximately $1.5 million daily and was in a critical state of disrepair.<\/p>\n
Taxpayers now face a considerable financial burden, as the sale of the plant is supported by a $2.4 billion rescue package from state and federal governments. KordaMentha’s recent documents reveal that their fees for a two-week period amounted to $1.3 million, or about $93,000 a day, due to the extensive work required to prepare the steelworks for sale. They emphasized that the remuneration reflects the level of effort needed to manage the complex situation, underscoring the importance of these assets for both the local community and Australia\u2019s steel industry as a whole.<\/p>\n
